Local watchdog group wins lawsuit

A citizens group that exposed illegal permitting practices by the Hollidaysburg Borough, won a lawsuit against the Zoning Hearing Board for issuing improper construction variances to a local developer.

This concerns the replacement of a burned down apartment building at Newry and Bedford Streets.

The board issued Csikasz Realty a variance, approving 8 apartments instead of the allowable 5.

In his ruling issued March 22, Court of Common Pleas Judge Stewart Kurtz described the evidence presented for a variance as “meager” and declared the ZHB ruling an “abuse of discretion”.

The watchdog group believes there are other construction projects this ruling could impact.
