The 25-year old is accused of shooting Caressa Kovalcik back on May 31st. Blough admitted to the shooting according to court documents but said it was an “accident.” Kovalcik was nine months pregnant, doctors tried to save the baby but she has been hospitalized ever since. Now a court has to decide if Kovalcik’s parent’s can take custody of the child and force the father to relinquish his rights.
The custody hearing was set for Wednesday morning but was continued. Attorney’s for Blough had no comment on the hearing neither did the district attorney.
Attorney Tom Dickey from Altoona, who is not in anyway involved in the case said in general parents make decisions about continuing life support. He said the outcome of the civil case can impact the outcome of the criminal case especially if the decision is made to take the child off of life support.
"Even though they were the ones that took the child off life support, the defendant could still be charged with the death even though they fought to keep the child alive," said Dickey.
